The Nut Graph‘s intrepid journalist Zedeck Siew reports that on 16th February 2009, our illustrious Home Minister by virtue of the Internal Security (Prohibition On Use of Specific Words on Document and Publication) Order 2009 [PU(A) 62/2009] has decreed as follows:- The printing, publication, sale, issue, circulation and possession of any document and publication relating […]
The Economy – a stimulating idiot’s guide
Ha…ha… bloody HA. Malaysia apparently is – or is it “was”? – “insulated” from the global economics meltdown. Like, awesome dood! While the rest of the world – America, Japan and Germany included – were knocked out silly by the meltdown, Malaysia was smiling her way to an economics safety vault. These were respectively the […]
Ruling and the Ruled: A Layperson’s Guide to the Constitutional Issues of Terengganu and Perak
LB.com received this today. It was written by a person whose identity cannot be revealed, only to be known as “A Perak Voter”. And the person is not Lord Bobo. It is an important read. MUCH has been said about the Perak constitutional crisis. But let us compare this with the purported crisis that erupted […]
A Question of Etiquette
I notice nowadays that Counsel just love the phrase mala fide. Never mind them not really understanding the phrase. Another phrase which many Counsel love nowadays is “misleading the Court”. Sometimes we impress a point of law to the Judge and tell the Judge what a case may mean. The opposite Counsel then has a different view. That would be alright. All he needs to say then is that “I beg to differ from my learned friend on his reading of the case”. But no. Nowadays many Counsel would say, “He is misleading the Court!”. Good God! What is happening to our profession?
The Romance of Human Rights
On Valentine’s Day, 14.2.09, the Malaysian Law Students Alliance (MALSA) together with the Bar Council co-organised a Human Rights Forum to raise human rights awareness due to the many violations of fundamental human rights that have been happening in the country. The forum took off at 2.30 pm at the Bar Council Auditorium. There were […]
“The human spirit has proven for generations through many revolutions and civil wars that liberty and freedom is worth more than life itself…”: Gregory Marimuthu
Welcome speech by the President of MALSA, Gregory Marimuthu, at the Valentine’s with Human Rights Forum on 14 February 2009, Bar Council. The obvious interdependence between peoples of different continents, the rapid growth of population and increasing contact between peoples and governments are the fundamental reasons for the promotion of Human Rights. Equality enhanced would […]
Judicial Appointments Commission: No Representation from the Bar
It is unfortunate that the Government did not appoint any representative from the Bar Council to the newly constituted Judicial Appointments Commission (‘JAC’). The Bar has a legitimate interest to be involved in the appointment and promotion of judges. It is part of the wider duty of the Bar (a) to uphold the cause of justice without regard to its own interests or that of its members, uninfluenced by fear or favour; and (b) to protect and assist the public in all matters touching ancillary or incidental to the law (s 42(1)(a), (g), Legal Profession Act 1976).
Something is rotten in the state of Perak: A Speculative Whodunnit
Mr. Jaspal Singh of the New Straits Times has written a curious news report today titled ‘Technical flaws in Pakatan suit may hold up hearing’. My interest in his report is not for the content. It is the usual propaganda that purports to pass off as news. No, my interest this time is in the judicial source for his report.
Will there be a Silver Lining in Perak?
Sultan Azlan’s decision to allow Barisan Nasional (BN) to form a new Government in Perak has incurred the wrath of many people.
Valentine’s with Human Rights Forum, 14 Feb 2008
What’s an excellent way to spend Valentine’s Day? At the Valentine’s with Human Rights Forum! Organised by the Malaysian Law Students Alliance (MALSA), and supported by the Bar Council, this is the plug:
Royale Luck
Royalties tend to have more patience than most of us because they live off our hard earned money, don’t have to work if they don’t want to, use their positions for business, marry and divorce as often as they like (all on our money of course), can sell titles, can give titles in exchange for […]
The Real Question on Perak
Historically, before the existence of Malaysia, the Malay States fell into the hands of the imperialists due to greed and power. It was about the power struggle amongst the royalty which eventually led to the colonisation of the States. Pre-Merdeka, with the emergence of the insurgencies by the left, a “deal” was struck among the […]
Perjuangan Peguam-Peguam: Cara dan Pengaruh Biasa v Berlainan?
Dalam temuramah “Cross Talk: Making of the hybrid lawyer of tomorrow” yang diaturkan oleh Aniza Damis (New Straits Times, 31 Januari 2009) dan disalin di bawah, kita dapat menilai bahawa bukannya visi atau objektif Badan Peguam yang bercanggah, tetapi cara menyuarakan mesej Badan Peguam yang berbeza. Outside of court, what should lawyers be doing with […]

Kematian Kugan: Suatu Tragedi Yang Menuntut Suatu Revolusi
Walaupun isu […]
Support the ICC!
The I v P conflict has once again shown the need for nation States to sign the Rome Statute of the International Criminal Court. Why? See the Malaysian Bar’s press release here. Strange that the Malaysian Government does not seem to support the Court when we go around speaking up for and assisting victims of […]
